1. Agreement to Terms

By accessing or using tracking.food ("the Service"), operated by Serviette LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

tracking.food is a ChatGPT application that enables users to track their dietary intake and nutrition through text, voice, and photo inputs. The Service uses artificial intelligence to analyze food information and provide nutritional data and insights.

3. Use of Service

3.1 Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.

We reserve the right to modify subscription prices at any time. Price changes will be communicated to you in advance and will apply to subsequent billing periods.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Serviette LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing the Service.

7. Disclaimers

7.1 Nutritional Information

The nutritional information provided by the Service is for informational purposes only and should not be considered medical or dietary advice. Nutritional data is estimated and may not be accurate for all foods or portions. Always consult with a healthcare professional before making significant dietary changes.

7.2 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, Serviette LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Serviette LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Third-Party Services

The Service operates as a ChatGPT application and integrates with OpenAI's ChatGPT platform. Your use of the Service is also subject to OpenAI's terms of service and privacy policy. We are not responsible for the availability, accuracy, or content of third-party services.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us or using account deletion features within the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Severability
